THE HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION Nos.2094, 2484 and 2538 of 2018 COMMON ORDER:

All the three writ petitions are being disposed of by way of common order, as the issue raised in these writ petitions is one and the same.

Counsel for the petitioners seeks permission of the Court to permit the petitioners to prefer an appeal against the orders of the removal.

Counsel for the petitioners had contended that the Enquiry Officer has not given any opinion about the charge whether it is proved or not. In spite of the same, the disciplinary authority has imposed penalty of removal, which is contrary to the rules and also to the findings of the Enquiry Officer.

This Court, having considered the said submission, is of the view that if the petitioners prefer an appeal within a period of two weeks from the date of receipt of a copy of this order, the appellate authority shall consider the same and pass appropriate orders within six weeks thereafter, in accordance with law. With these observations, the writ petitions are disposed of. Miscellaneous Petitions pending, if any, shall stand closed. No order as to costs.
