Nikhat Parveen v. The District Collector (Rev),
THE HON'BLE SRI JUSTICE A.ABHISHEK REDDY WRIT PETITION No.2077 of 2009 ORDER:
This writ petition is filed seeking the following relief: " ... to Call for the Records in Proceedings Lr.No.B/2616/2006 dated 20-12-2008 issued by the Respondent No.2 based on the 2nd Survey Report, as illegal, arbitrary, Malafide, unconstitutional, null and void and consequently direct the respondents to not to dispossess the petitioner from her land i.e. open plot measuring 614 Square yards in Survey No.47/2 situated at Kokat Village, Yalal Mandal, Ranga Reddy District without following due process of law .."
2. Today, when the matter is called, the learned counsel for the petitioner has placed on record Memo No.A/212/2017, dated 31.12.2017, issued by the Tahsildar, Yalal Mandal, wherein the petitioner has sought information under the Right to Information Act, 2005. In the said memo, it is stated that the applicant/writ petitioner has not encroached into survey No.52, which was allotted for lorry parking, and that she has not encroached any land in survey No.52 and as a matter of fact, the physical possession of the open plot by the applicant/writ petitioner in survey No.47/2 does not affect the land in survey No.52.
3. The learned Government Pleader appearing on behalf of respondents 1 and 2, on instructions, has not disputed the Memo dated 31.12.2017.
4. In view of the above, the apprehension of the petitioner that the respondents are trying to evict her from the open plot admeasuring 614 square yards in survey No.47/2 situated at Kokat Village, Yalal Mandal, Ranga Reddy District, is baseless, and the grievance of the writ petitioner stands redressed by the survey conducted by the Mandal Surveyor, Yalal Mandal, and the location sketch, which is annexed to the memo dated 31.12.2017. Thus, in view of the Memo, dated 31.12.2017, the question of the respondents evicting the petitioner from the subject land does not arise.
5.
Therefore, taking on record the memo dated 31.12.2017, the Writ Petition is disposed of.
6. As a sequel, miscellaneous petitions pending in this writ petition, if any, shall stand closed. No orders as to costs. ________________________ A.ABHISHEK REDDY, J 07.11.2019.
