SMT JUSTICE T.RAJANI CRIMINAL APPEAL No.294 OF 2018 JUDGMENT:

This Criminal Appeal is preferred against the docket order, dated 07.12.2015, passed in C.C. No.807 of 2015 by the learned Judicial Magistrate of First Class at Godavarikhani, Karimnagar District (for short, 'the Court below'); by virtue of which, the Court below dismissed the complaint on the ground that the complainant was absent since long time, process not paid, and there was no representation on his behalf. 2.

Learned counsel for the appellant/complainant draws the attention of this Court to the docket order dated 07.07.2015 in C.C. No.807 of 2015, wherein it was mentioned that the complainant was absent and process was paid. Hence, in view of the earlier docket order dated 07.07.2015, the impugned docket order, dated 07.12.2015, of the Court below, cannot be sustained.

Accordingly, the Criminal Appeal is allowed by setting-aside the order dated 07.12.2015 passed in C.C. No.807 of 2015 by the Court below.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
