THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.34160 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner was appointed as a fair price shop dealer of shop No.2, Yelukur Village, Maldakal Mandal, Mahabubnagar District. While so, on the basis of the report submitted by the fifth respondent dated 20.12.2014, a show cause notice was issued to the petitioner by the third respondent on 09.01.2015. The petitioner submitted his explanation on 28.01.2015. After receiving the explanation, the authorization of the petitioner was suspended, by proceedings of the third respondent dated 24.04.2015. Challenging the same, the petitioner filed W.P.No.14213 of 2015 and this Court allowed the same on 03.06.2015 setting aside the order of suspension, but giving liberty to the third respondent to take appropriate action in respect of the allegations leveled against the petitioner. Thereafter, the third respondent issued a notice on 25.08.

2015 directing the petitioner to appear before him for hearing on 29.08.2015. Accordingly, the petitioner appeared before the third respondent on 29.08.2015 and submitted his explanation, and after considering the explanation and personal hearing, the third respondent passed an order on 21.09.2015 cancelling the authorization of the petitioner. Challenging the same, the present Writ Petition is filed.

3. This Court carefully perused the impugned order dated 21.09.2015 and feels that the charges framed against the petitioner require investigation. In view of the same, this Court is not inclined to go into merits of the case. But, in view of the availability of alternative remedy of appeal, liberty is given to the petitioner to file an appeal against the impugned order within a period of 15 days from the date of receipt of a copy of this order.

4. The Writ Petition is, accordingly, disposed of. Miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
