ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.
The petitioner was appointed as Fair Price Shop Dealer for Shop No.55 of China Erlapadu village, Kanigiri Mandal, Prakasam District. While so on 9.12.2014 the Enforcement Deputy Tahsildar along with his staff inspected the Fair Price Shop of the petitioner and found some irregularities. Thereafter he submitted a report to the third respondent, who issued a show cause notice on 20.02.2015 asking the petitioner to submit his explanation. The petitioner submitted a detailed explanation on 16.3.2015. However, the third respondent by order dated
6.3.2015 holding that the petitioner did not submit any explanation, cancelled his authorization. Against the said order of cancellation, the petitioner preferred an appeal to the second respondent on 15.4.2015 and when the said appeal was not disposed of by the second respondent even after lapse of three months, the present Writ Petition is filed.
In view of the pendency of the appeal preferred by the petitioner before the second respondent, this Court is not inclined to go into the merits or otherwise of the subject matter at this stage. However, as the petitioner had already filed his explanation on 16.3.2015 to the show cause notice dated 20.02.2015, the third respondent is directed to complete the enquiry and pass final order after due opportunity to the petitioner and in accordance with law within a period of sixty days from the date of receipt of a copy of this order. The Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
