THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.771 of 2022 ORDER:

This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A.2, for grant of bail in Crime No.120 of 2021 of Nadigudem Police Station, Suryapet District, registered for the offence punishable under Section 8 (c) read with 20 (b) (ii) (C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'the NDPS Act').

Heard the learned counsel for the petitioner/A.2, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

In the course of submissions, it is brought to the notice of this Court that accused Nos.2 and 3 were granted bail vide order, dated 02.03.2022 in Crl.P.No.768 of 2022 by this Court. Similar allegations are made against the petitioner/A2. Considering the totality of the circumstances, the petitioner/A2 is also entitled for bail under Section 439 of Cr.P.C on the following terms and conditions:

Accordingly, the petitioner/A2 is ordered to be released on bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties in a like sum each to the satisfaction of the learned Principal Judicial Magistrate of First Class, Kodad. On such release, the petitioner/A2 shall report before the Station House Officer, Nadigudem Police Station, Suryapet District, on every Sunday between 10:00 AM and 1:00 PM, till the trial is completed. Further, the petitioner/A2 shall not leave the State without prior permission of the concerned Court.

The Criminal Petition is, accordingly, allowed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
