OFFICE NOTE 21.08.2023 KS, J I.A.No.1 of 2023 This interlocutory application is filed for relaxation of the condition imposed by this Court in the order dated 14.06.2023 passed in criminal petition No.1146 of 2021 i.e. This Court while granting bail on 14-06-2023 stated as follows:

"The petitioner shall surrender his passport before the Metropolitan Sessions Judge-cum-Special Court constituted under P.M.L Act, Hyderabad at the time of execution of bonds and he shall not leave the territory of India and also headquarters of Hyderabad without prior permission of the Said Court".

Learned senior counsel appearing for petitioner would submit that the petitioner abiding of the condition of this Court that he was staying in Hyderabad whole time. However, the learned special counsel appearing for the E.D would submit that call data of his phone was not available from 21-06-2023 to 01-07-2023 and 14-07-2023 to 05-08-2023, total 26 days.

Learned counsel further submit that since the call data was not available it has to be assumed that the petitioner had left Hyderabad in violation of the conditions of this Court.

However, no proof is filed to show that the petitioner was out of Hyderabad at the same time.

However, keeping in view that the petitioner was not summoned at any point of time after grant of bail, this Court deems it appropriate to relax the condition to the extent of leaving Headquarters of Hyderabad not to leave territorial of India remains the petitioner shall appear as and when summoned by the Enforcement Directorate.
