THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.2439 of 2018 ORDER:

This Writ Petition is filed questioning notice, dated 23.12.2017 proposing to conduct auction of house property bearing H.No.1078 (Old H.No.1-30), admeasuring 186.66 sq.yards, in Survey No.5, situated at Bommakal, Karimnagar District, on 27.01.2018.

When the matter is taken up, learned counsel for petitioner submits that public auction with regard to sale of immovable property scheduled on 27.01.2018 was not conducted and it can be conducted only by issuance of fresh notice in accordance with the Rules applicable and therefore, he seeks permission of this Court to withdraw the Writ Petition with liberty to the petitioner to approach this Court as and when cause of action arises. Permission is accorded and the Writ Petition is dismissed as withdrawn with liberty in terms of the prayer made. Miscellaneous Petitions, if any pending shall stand dismissed.
