HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.14340 OF 2015 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to issue a writ of mandamus declaring the action of the respondents in not issuing hall ticket/call letter to the petitioner for the written test going to be held on 10.05.2015 for the post of Junior Mining Engineer Trainee (JMET), though he is fully eligible and applied within the time as arbitrary, illegal and consequently to direct the respondents to issue hall ticket/call letter to the petitioner for the written test going to be held on 10.05.2015 for the post of Junior Mining Engineer Trainee (JMET) pursuant to the employment Notification No.1 of 2015.

2. Heard the leaned counsel appearing for the petitioner and the learned counsel appearing for the respondents.

3. The respondent issued employment notification, dated 08.02.2015 and 11.02.2015 inviting applications for the post of Junior Mining Engineer Trainee on permanent basis. As per the notification, the eligibility criteria is Diploma in Mining Engineering from any State Board of Technical Education approved by A.I.C.T.C. apart from other requirements mentioned therein. As the marks statement submitted by the petitioner indicated that the petitioner failed in one subject, the respondent did not issue him the hall ticket. Thereafter, the petitioner filed the present writ petition and sought an interim direction permitting him to write the examination. The learned single Judge of this Court by order dated 08.05.2015 issued interim direction to the respondent to allow the petitioner to write the written examination. Accordingly, the petitioner wrote the written examination held on 10.05.2015.

Learned counsel appearing for the petitioner submits that after declaration of the results, the petitioner applied for revaluation and in the revaluation, it was declared that he passed the final year examination and therefore, now he is eligible for the post applied for. The writ petition, however, is filed seeking a direction to permit the

petitioner to write the written examination.

In view of the submission made by the learned counsel appearing for the petitioner, the petitioner is directed to submit all the certificates to the respondents and on verifying the certificates, the respondents shall examine the eligibility of the petitioner for the post of Junior Mining Engineer Trainee in accordance with rules and pass the appropriate orders.

6. With the aforesaid direction, the writ petition is disposed of. There shall be no order as to costs.
