HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 25725 of 2016 Order:

The petitioners passed Vocational Courses offered by the Board of Intermediate Education, which are equivalent to that of ITI (Electrical Trade). After completion of the course, they have undergone "Apprenticeship Training" in Northern Power Distribution Company of AP Limited, Khammam. They have been working as Assistant and Contract Labour under the regular Lineman of the respondentCompany and attending to the works. The maintenance of substations and other works were entrusted to the private contractors and the contractors issued notification on 28.05.2016 calling for the applications for filling up the vacancies of "Shift Operators". As per the said notification, the required qualification is ITI (Electrical Trade). But, it is the case of the petitioners that when they approached the fourth respondent, they were informed that the vocation course certificates obtained by them will not be considered as ITI (Electrical Trade) and, hence, they are not eligible. Challenging the said action, the present Writ Petition is filed.

2. When this Writ Petition came up for consideration on 02.08.2016, it was adjourned to today directing the learned Standing Counsel for the respondents to get instructions. Learned Standing Counsel for the respondents, on the basis of instructions, submits that for 16 posts, 601 applications were received including the candidates possessing Inter Vocational Course and the applications of the petitioners were also considered. A merit list of candidates was prepared in the ratio of 1:5 for the purpose of pole climbing. The marks obtained by the petitioners are as follows.

1. Sk. Kamal Pasha - 15

2. Pingali Mahesh Babu - 42

3. Kotamarthi Ramesh - 10

4. Oruganti Madhusudhan Rao - 05

In view of the less number of marks obtained by the petitioners, as per the guidelines of NPDCL, the petitioners did not come up in the merit list and, accordingly, their cases are not considered.

3. In view of the statement of the learned Standing Counsel for the respondents, the Writ Petition is dismissed. There shall be no order as to costs.

4. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
