HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.11570 of 2015 ORDER:
Heard the learned counsel appearing for the petitioner and the Government Pleader for Civil Supplies for the State of Andhra Pradesh.
2. This writ petition is filed seeking writ of Mandamus declaring the action of the 3rd respondent in issuing suspension-cum-show cause notice dated 20.03.2015 by suspending the authorisation of the petitioner as Fair Price Shop dealer of Shop No.1, Gudibanda Village and Mandal, Anantapur District, as illegal and arbitrary.
3. The petitioner's fair price shop was inspected by the Vigilance and Enforcement authorities and certain variations have been noticed. This apart, some other irregularities have also been noticed as pointed out in the show cause notice cum suspension order. Learned counsel appearing for the petitioner submits that the variations in the stock allegedly noticed are within the permissible limits. As the authorisation of the petitioner was suspended pending enquiry, this Court is not inclined to go into the merits of the suspension order and a detailed enquiry has to be conducted against the petitioner.
4. Under these circumstances, the 3rd respondent-Revenue Divisional Officer, Penukonda, Ananthapur District, is directed to conduct enquiry against the petitioner and pass final orders within a period of six (6) weeks from the date of receipt of a copy of this order.
5. The writ petition is accordingly disposed of at the stage of admission. Miscellaneous applications, if any, in this writ petition, shall stand closed. No order as to costs.
