The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri K Muralidhar, Advocate for the Petitioner, and of Additional Public Prosecutor for the respondent, the Court made the following.

THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.986 ot 2020 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by petitioner/A2, seeking to grant anticipatory bail to him in Crime No.16 of 2019 on the file of Panjagutta Police Station, Hyderabad District, registered for the offences under Sections 353, 323 read with Section 34 IPC 2.
Heard learned counsel for the petitioner/A2, learned Additional Public Prosecutor representing the respondent-State and perused the record.

lt is alleged in the complaint that on 12.01.2019, while the defacto complainant along with another Constable was on patrolling duty on car and when they reached at Nllt/S hospital, an accident occurred by hitting two bikes and no person was injured in the accident, but both parties were beating each others. When the defacto complainant was trying to stop them, the accused abused them in filthy language and pushed them and they beat with hands on the face of other party persons resulting bleeding injuries 4.
Learned counsel for the petitioner/A2 submits that the t petitioner/A2 has nothing to do with the alleged offence and he was falsely implicated in the crime by the police with an intention to involve him in the case. He further submits that petitioner is a law abiding citizen without any criminal antecedents and he shall abide by any condition imposed by this Court.

Learned Additional Public Prosecutor opposed to grant anticipatory bail to the petitioner/A2.

ln view of the nature of allegations leveled against the petitioner/A2 and other facts and circumstances, without adverting to the merits of the matter, I am inclined to grant anticipatory bail to the petitioner/A2, by imposing some conditions.

Accordingly, the Criminal Petition is allowed and the petitioner/A2 is directed to surrender before the Station House Officer, Panjagutta Police Station, Hyderabad District, within a period of 15 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/A2 on bail on his executing a personal bond for a sum of Rs.'15,0001 (Rupees fifteen thousand only) with two sureties for a like sum each to his satisfaction. Further, the petitioner/A2 shall abide by the conditions stipulated in Section 438(2) Cr.P.C and co-operate with the investigating officer in investigating the case B.
