O R D E R
This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused No.1 in FIR No.1299 of 2025 of Raidurgam Police Station, Cyberabad Commissionerate, wherein the alleged offences were initially registered under Sections 109 r/w 3(5) of the BNS and later, after the death of the deceased, the Sections were altered to Sections 103, 309(6) r/w 3(5) of the BNS.

The case of the prosecution is that, on 10.11.2025, the de-facto complainant lodged a report before the police stating that, on 11.11.2025, at about 01:27 hours, the complainant received a Dial-100 call, wherein the caller reported that an unknown male person, aged about 20-30 years, while walking on the road towards Dargah, was attacked by 3-4 unknown male persons who came on motorcycles armed with sticks and assaulted him severely on various parts of his body. Immediately, the complainant proceeded to the reported location and found an unknown male person lying on the road in an unconscious condition, having sustained bleeding injuries on his head, forehead, and right eye. The injured person was immediately shifted to the Hospital for treatment and was admitted there.
During verification of CCTV footage, it was observed that the said person was walking towards Dargah Road from BNR Hills, and when he reached opposite to the Leather Factory, 3-4 unknown persons arrived on motorcycles, attacked him brutally with sticks, and attempted to kill him. Hence, the complainant requested to take necessary action. Basing on the said complaint, initially the police registered a case for the offences punishable under Sections 109 r/w 3(5) of the BNS and later, after the death of the deceased, the Sections were altered to Sections 103, 309(6) r/w 3(5) of the BNS.

Heard Sri Mohammed Aslam, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent - State.

Learned counsel for the petitioner submitted that the petitioner herein is arrayed as accused No.1 and he is innocent of the said allegations and he was falsely implicated in the present case and he is in jail since 17.11.2025 and the material part of the investigation was already completed and further, the custodial interrogation of the petitioner is not required for further investigation and he is ready to cooperate with the investigating authority. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner by filing counter stating that the allegations against the petitioner herein are serious in nature and the petitioner herein along with other accused brutally killed the deceased. Further, the investigation is not yet completed. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is in jail since 17.11.2025. As seen from the remand case diary, the prosecution witnesses, LWs 1 to 25 including the investigating authority have already been examined and as on today, no charge sheet is filed. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions: i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned XIII Additional Judicial Magistrate of First Class, at Rajendranagar.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is

iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
