THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.8803 OF 2017 ORDER:

This petition is filed under Section 482 of Criminal Procedure Code (for short " Cr.P.C." ) to quash the proceedings in C.C.No.166 of 2017 pending on the file of the Judicial Magistrate of First class, Udayagiri, SPSR Nellore District for the offence punishable under Section 498-A IPC and Sections 3 and 4 of Dowry Prohibition Act on various grounds. When the matter came up for hearing, the learned counsel for the petitioners requested this Court to dispense with the appearance of the petitioners before the trial Court on all dates of hearing. But, this Court cannot pass such an order. However, the petitioners are permitted to move appropriate application under Section 37 of Criminal Rules of Practice and under Section 205 Cr.P.C. and on filing such application, the court below is directed to pass appropriate orders, in accordance with law.
