HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN Civil Revision Petition No.835 of 2018 ORDER:

Aggrieved by the refusal of the trial Court to grant interim injunction, but granting only an order of status quo, the plaintiffs filed an appeal. The same having been dismissed, the plaintiffs have come up with the above revision.

2. Heard Parsa Ananth Nageswara Rao, learned counsel for the revision petitioners.

3. The suit filed by the petitioners herein was one for perpetual injunction. Pending the suit, the petitioners sought an interim injunction restraining the respondents from interfering with their possession and enjoyment. The trial Court, instead of granting injunction, granted an order of status quo. The Appellate Court confirmed the same. Contending that the respondents have no semblance of a right and that therefore, the Courts below ought to have granted an injunction, the petitioners are before me.

4. As pointed out earlier, the suit is one for perpetual injunction. The Courts below have chosen to exercise caution and granted only an order of status quo. I do not think that there is any irregularity or illegality warranting interference in the concurrent findings of the Courts below.

Hence, the Civil Revision Petition is dismissed. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
