THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI CIVIL REVISION PETITION No.5502 of 2011 ORDER:

This Civil Revision Petition, by the plaintiffs, under Article 227 of the Constitution of India, is directed against the order dated 23.06.2009 in O.S.No.153 of 2005 of the learned Principal Junior Civil Judge, Avanigadda, Krishna District, whereby the learned Junior Civil Judge directed the plaintiffs to pay required stamp duty and penalty on the agreement of sale before it is tendered for being marked as an exhibit. At the hearing, learned counsel for the revision petitioners would submit that in view of the lapse of time since 2009 up to date, the issue raised in this revision for consideration has become stale and that there are no instructions from the plaintiffs as to what is the stage of the present suit and, therefore, the revision petition may be closed. Having regard to the facts and the submissions, this Court is of the considered view that the revision petition can be closed, however, confirming the order of the Court below, as no submissions are made on the merits of the matter.

Accordingly, the revision petition is closed. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this civil revision petition shall stand closed.
