THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.2494 of 2018 Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Urban Development and the learned Government Pleader for Home (Telangana).

When the matter is taken up, learned Government Pleader for Home has placed on record the written instructions, dated 29.01.2018, furnished by the Sub-Inspector of Police, Jaffargadh Police Station, Jangaon District. The said instructions read as under:

"The petitioner herein has approached the police of Jaffarghad Police Station, Warangal District and submitted a petition dated 5.1.2018 stating that one Mr.Sakinala Dudaiah, son of Agagiah (4th respondent herein) has demolished his own compound wall with a dozer on 5.1.2018 and hence requested to take action by registering an FIR and pay compensation from him. Upon receipt of the said petition, an entry was made into the Station General Diary on 5.1.2018 and immediately advised the petitioner to seek his redressal in a competent court of law since the dispute is purely civil in nature and the respondent police have nothing to do with it. The said fact was also intimated to the petitioner herein then and there. However, he filed the present writ petition.

It is humbly submitted that since the dispute of the petitioner herein and as well as the 4th respondent herein is purely civil in nature and immediately advised

the petitioner to seek his redressal in a competent court of law but no action was taken.

It is humbly submitted that the petitioner is unnecessarily trying to involve the respondent police into his personal and civil disputes who are no way concerned with it.

It is pertinent to submit that this respondent are not the competent authorities to direct the 4th respondent to pay compensation for the alleged demolition of the compound wall of the petitioner herein.

In view of the above facts and circumstances, this respondent shall abide by the directions if any passed by this Hon'ble Court".

Accordingly, the Writ Petition is disposed of, by placing on record the above written instructions, keeping it open for the petitioner to avail the alternative remedies open to him. As a sequel thereto, miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ________________ A.V.SESHA SAI 30th January, 2018.
