HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No. 772 OF 2022 O R D E R:

This Criminal Petition under Section 438 Cr.P.C. is filed by the petitioner - Accused No. 2 seeking bail in the event of his arrest in connection with Crime No. 764 of 2021 on the file of Raidurgam Police Station, registered for the offences punishable under Sections 342 and 506 IPC.

The case of the prosecution is that on 07.12.2021, the de facto complainant lodged a report stating that on 06.12.2021 he along with his friends Sri Raji Reddy and Padmini went to Good Vibes Café at Khajaguda and after some time, his friends left from the said place and he was moving towards his car. It is alleged that at that time, some unknown persons four in number came to him stating that they are task force police and forcibly took him in their car bearing Registration No. TS 08 GZ 7745 and took away his mobile phone and took him to Sunny Krishna Seed Company at Dundigal, beat him with rods mercilessly and demanded Rs.5 lacs and threatened him to call his wife to transfer the said amount to the account of Siri More Feeds Private Limited. It is also alleged that accordingly, the de facto complainant called his wife and asked to transfer the cash and later in the midnight, he was shifted to Sunny Krishna Office at Yousufguda and demanded for further money, however, on 07.12.2021, he escaped from their clutches and went to his house.

Learned counsel for the petitioner Sri D. Mohan Rao submits that Accused No.1 was already granted regular bail by this Court, hence, the case of this petitioner, who is Accused No.2 may also be considered for grant of pre-arrest bail. 4.

Looking at the allegations in the remand report where there are specific overt acts against Accused Nos. 2 to 5 that they kidnapped the complainant, this Court is not inclined to grant pre-arrest bail to the petitioner-Accused No.2. 6.
