THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.854 OF 2018 ORDER:

This petition is filed by the petitioner-A8 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.309 of 2017 on the file of the Station House Officer, Vempalli Police Station, YSR Kadapa District, which was registered for the offences punishable under Sections 406, 409, 420, 465, 468 and 472 IPC.

Heard learned counsel for the petitioner, learned Assistant Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner-A8 would submit that the petitioner is paying instalments with regard to the loan obtained by him.

The specific allegation against the petitioner is that he has filed bogus pattedar pass book and obtained loan from the bank, which is meant for agriculture. It cannot be said that the allegations do not constitute the offences referred supra. Further, it cannot be said that the continuation of proceedings would be an abuse of process of law. Therefore, the petition is devoid of merit and is liable to be dismissed.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
