THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.834 OF 2019 ORDER:

Heard the learned counsel for the petitioner/A-1 of Crime No.298 of 2018 of Women Police Station, Begumpet, registered for the offences punishable under Sections 498-A & 506 of Indian Penal Code, 1860 (for short, 'IPC') and Sections 4 & 6 of Dowry Prohibition Act, 1961, which is outcome of the report of the de facto complainant, no other than his wife, not only against the petitioner/A-1, but also against mother-in-law and sister-in-law of the de facto complainant, who obtained anticipatory bail in Crl.M.P.No.163 of 2019 in the present crime and perused the grounds urged in the anticipatory bail application and the FIR contents and the order of dismissal of the bail application of the petitioner/A-1 by the learned V Additional Metropolitan Sessions Judge (Mahila Court), Hyderabad, dated 31.01.2019, in Crl.M.P.No.162 of 2019.

A perusal of the very FIR no way deserves the concession of anticipatory bail by the petitioner/A-1, husband of the de facto complainant, but for to say for none of the offences punishable above seven years, police strictly follow Section 41-A of the Code of Criminal Procedure, 1973.

Accordingly, rather than dismissal, the Criminal Petition, is disposed of.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
