HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No.775 of 2022 O R D E R:

This Criminal Petition under Sections 437 and 439 Cr.P.C. is filed by petitioner - Accused No.2 in Cr.No.300 of 2021 on the file of Nalgonda Rural Police Station, Nalgonda District, registered for the offence punishable under Section 302 read with 34 IPC, seeking bail. 2.

The case of prosecution is that on 19.12.2021 at 15.00 hours, the de-facto complainant lodged a complaint stating that on 18.12.2021 at about 9.30 pm., her mother and younger brother beat her father, namely Arukonda Lachaiah, indiscriminately with sticks and killed him as he was addicted to alcohol and harassing them in drunken condition.

Learned counsel for petitioner Mr.P. Shashi Kiran, submits that the Court below has granted bail to A1 by order dated 07.02.2022 in Crl.M.P.No.27 of 2022 in Cr.No.300 of 2021 on the file of the Judge, Family Court-cum-VI Additional Sessions Judge, Nalgona, wherein it was observed that most part of the investigation is completed and as the investigating officer did not show any reasonable ground for further detention of A1, granted bail to A1 with conditions. Learned counsel further submits that as A1 was already granted bail by the Court below, the case of petitioner/A2, who is similarly situated, also may be considered for grant of bail.

On the other hand, learned Assistant Public Prosecutor submits that A1 was granted bail by the Court below on 07.02.2022.

Taking into consideration the fact that A1 was already granted bail by the Court below, this Court deems it appropriate to grant bail to petitioner/A2 on the same terms and conditions as imposed by the Court below.

The Criminal Petition is therefore, allowed. Petitioner - A2 shall be enlarged on bail in connection with Cr.No.300 of 2021 on the file of Nalgonda Rural Police Station, Nalgonda District, on her executing a personal bond for a sum of Rs.30,000/- (Rupees thirty thousand only) with two sureties for a like sum each to the satisfaction of the Judicial First Class Magistrate (Mobile Court) at Nalgonda. Petitioner - A-2 shall appear before the Station House Officer, Naglonda Rural Police Station on every Sunday once in between 10.00 am and 1.00 pm for one month from the date of release or till tiling of the charge sheet whichever is earlier. The petitioner-A2 is also directed to deposit her passport before the said learned Magistrate after release from the jail and if she is not having passport, she should file an affidavit to that effect. _______________________ LALITHA KANNEGANTI, J 9th February, 2022 sj
