Heard the learned counsel appearing for the petitioner and the learned Government Pleader for the Civil Supplies (AP).
2. This writ petition is filed seeking Writ of Mandamus declaring the show cause cum suspension order Vide Rc.No.140/2015-E, dated 28.02.2015 issued by the 3rd respondent in suspending the petitioner's F.P. Shop authorisation of Shop No.31, N.Venkatampalli Village H/o Nijavalli Village, Kundurpi Mandal, Ananthapuramu District, as illegal and arbitrary and for a consequential direction to the respondents to continue the petitioner as Fair Price shop dealer.
3. The authorisation of the petitioner was suspended by the 3rd respondentRevenue Divisional Officer, Kalyanadurg, Ananthapuramu District, vide orders dated 28.02.2015, pending enquiry. The reason for order of suspension seems to be that certain irregularities were committed by the petitioner, who is the Fair Price Shop dealer and there was variation in the stocks of the commodities noticed at the time of the inspection by the authorities. Learned counsel appearing for the petitioner submits that in fact, there were no variations and the petitioner could not be able to prove the same before the inspecting authority, as the Revenue Inspector took away the Sales Register and Stock register for verification.
4. Admittedly, the order impugned is passed pending enquiry. In the circumstances, the 2nd respondent-Revenue Divisional Officer, Kalyandurg, Ananthapuram District, is directed to conduct enquiry against the petitioner and pass final orders, within a period of four weeks from the date of receipt of a copy of this order.
5. The writ petition is accordingly disposed of. Miscellaneous applications, if
