THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.840 OF 2019 ORDER:

The petitioner is A-2 among two accused of Crime No.25 of 2019 of Chandrayangutta Police Station, Hyderabad, registered for the offence punishable under Section 379 of Indian Penal Code, 1860. 2.

Heard the learned counsel for the petitioner in the anticipatory bail application and also the learned Public Prosecutor in opposing the same representing the respondent State. Perused the material on record.

The alleged theft is of the four CC TV cameras along with DVR from the construction site of the de facto complainant in their frequently coming there and creating panic to extort money and as part of that game, stolen the CC TV cameras and the DVR so that it may not be covered of their illegal acts. Though the crime is registered only for Section 379 IPC, it also involves the offence of extortion and criminal intimidation, thereby merely because A-1 arrested and from his disclosure, it also discloses the privy of A-2, granted regular bail, the petitioner is not entitled to concession of anticipatory bail, but for to say none of the offences punishable above seven years, police strictly follow Section 41-A of the Code of Criminal Procedure, 1973.

Accordingly, rather than dismissal, the Criminal Petition, is disposed of.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
