CoMPLAINANT(S) Petition under Section 528 of B.N.S.S. praying that in the circumstances stated in the Merhorandum of Grounds of Criminal Petition, the High Court may be pleased to pass orders directing the Deputy Commissioner, Prohibition and Excise, Nalgonda Division, to issue appropriate directions to the Station House Officer, Nampally Prohibition and Excise Station, Nalgonda District, or any other competent authority having custody of the vehicle, to forthwith release the Petitioner's Maruti WagonR Car bearing Registration No. TS-07-HV-9219, seized in C.O.R. No.55 of 2025, in view of the quashment of the entire proceedings in C.O.R. No.55 of 2025 pursuant to the orders passed by this Court in Criminal Petition No.17401 of 2O2l,dated 2)-12-2025.
This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri Patnamshetty Sai Sharan, Advocate for the Petitioner and Sri fttl.Ramachandra Reddy, Additional Public Prosecutor for the State of Telangana on behalf of the Respondent No.1 and none appeared for Respondent No.2.

This Criminal Petition has been filed seeking a direction to the Deputy Commissioner, Prohibition and Excise Station, Nalgonda Division, to issue appropriate directions to the Station House Officer, Nampally Prohibition and Excise Station, Nalgonda District or any other competent authority having custody of the vehicle to forthwith release the petitioner's vehicle namely Maruti WagonR Car bearing registration No.TS-O7-IIV-92I9, in view of

the quashing of the proceedings in C.O.R. No.55 of 2025 by this Court in Criminal Petition No.l740 | of 2025 dated 2Z.\Z.Z0Z5. 2- Heard Mr. P. Sai Sharan, learned counsel for the petitioner and Mr. M. Ramchandra Reddy, learned Additional public Prosecutor for respondent No.1.

Learned counsel for the petitioner submitted that the petitioner is the owner of the Maruti wagonR car bearing registration No.TS-}7-Hv-9219. The said vehicle was involved in c.o.R. No. 55 of 2025. The accused in the said crime approached this court and filed Criminal Petition No. 17401 of 2025, and this court allowed the said petition on2z.L2.zo2s.ln spite of the same, respondent No.2 has not released the said vehicle. Hence, the 'action of the said authority is contrary to the orders passed by this Court.

Per contra, learned Additional public prosecutor submits that the petitioner, without approaching the Deputy Commissioner of Prohibition and Excise, Nalgonda, by submitting an appropriate application for release of the vehicle, has straightaway approached this Court and filed the present criminal petition. However, in the event the petitioner submits an appropriate application, the Deputy ,// ./
Commissioner, Prohibition and Excise Station, Nalgonda Division will consider the same and pass appropriate orders. 5.
Having considered the rival submissions made by the respective parties and after perusal of the record, it reveals that it is not in dispute that the petitioner herein is not an accused in C.O.R. No.55 of 2025. However, the petitioner's vehicle was taken by accused in C.O.R. No.55 of 2025 on hire for transporting black jugg.ry and alum. The record further reveals that accused had approached this Court and filed Criminal Petition No.17401 of 2025 seeking quashing of the proceedings in C.O.R.No.55 of 2025 and the same was allowed on 22.12.2025. By virtue of the quashing of C.O.R.No.55 of 2025, the petitioner is entitled to the return of the subject vehicle.

Taking into consideration the facts and circumstances of the case, the petitioner is granted liberty to submit an application for release of the vehicle before the Deputy Commissioner of Prohibition and Excise, Nalgonda, enclosing a copy of this order, as well as the order dated 22.12.2025 in Crl.P.No.l74Ol of 2025. On receipt of such application, the Deputy Commissioner of Prohibition and Excise, Nalgonda is directed to consider the same and release the vehicle in favour of the petitioner after due
verification of the documents and after obtaining necessary authorization, within a period of three (03) days from the date of filing of the application.

Accordingly, the criminal petition is disposed of. j Pending miscellaneous applications, if any, shall stand i i i i closed.
