Heard learned counsel for the petitioner and learned Government Pleader for home for respondents 1 to 4. 2.

Petitioner claims to be the owner and in possession of house bearing No.20-620/4-1 situated at Garmilla Shivar, Mancherial Mandal and Mancherial District. Petitioner claims that he purchased the said plot in the year 2017. Petitioner alleges that in the year 2018, he came to know that his name was deleted from the municipal records in respect of his house and entered the name of mother of 5th respondent as owner, based on the decree obtained by a person by name Regalla Sudhakar and two others in O.S.No.432 of 2009. Petitioner alleges that no notice was given to him before change of ownership. Alleging illegalities in change of ownership and thereafter by break opening lock of the gate of the petitioner's house, the unofficial respondent along with others entered into his house and attacked the tenant of petitioner, petitioner lodged complaint on 10.10.2018.

The same is registered and investigation is pending. While so, petitioner now alleges that 4th respondent is calling him to the police station through his constables and threatening him to settle the dispute with the unofficial respondent and unnecessarily interfering in private civil disputes. In this writ petition, petitioner prays to declare the action of 4th respondent in interfering with the personal liberty and involving in civil disputes as illegal and arbitrary.

In the counter affidavit filed by the 4th respondent, the said allegations are denied. It is asserted that based on the complaint of petitioner, Crime No.459 of 2018 is registered under Sections 448, 427, 506 r/w.Section 34 of Indian Penal Code, on 22.10.2018 and investigation is pending. 4.

Except making vague allegations, no other material is placed on record by the petitioner to show that police are interfering in civil disputes, more so, when police have to investigate into crime on his complaint of illegal interference by third parties, break opening of lock and attacking the tenant of petitioner. No case is made out by the petitioner for interference by this Court and the same is liable to be dismissed. Accordingly, the Writ Petition is dismissed leaving it open to respective parties to work out their remedies vis-à-vis alleged dispute pending between them. Pending miscellaneous petitions, if any, shall stand closed.
