THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.832 OF 2019 ORDER:
The petitioner is A-6 in P.R.C.No.43 of 2018, pending on the file of the learned Committal Magistrate-cum-Chief Metropolitan Magistrate, Hyderabad, which is outcome of Crime No.228 of 2016 of Hussainialam Police Station, Hyderabad, taken cognizance for the offences punishable under Sections 147, 148, 302, 120-B & 212 read with 149 of Indian Penal Code (for short, 'IPC') and Section 27(3) of the Arms Act. The police, having registered the crime after investigation by citing including the Investigating Officers, 45 witnesses, filed the final report that was taken cognizance. 2.
Heard learned counsel for the petitioner/A-6 and the learned Public Prosecutor representing the respondent State and perused the material on record.

From the perusal of the police final report, particularly Page 4 onwards it clearly shows the name of the petitioner revealed from the investigation as the kingpin in commission of the crime. The fact that he is aged 80 years or NBW issued by the learned Committal Magistrate and police are behind him not grounds thereby to the concession of anticipatory bail from the propensity of crime, if at all he wants to surrender before the learned Committal Magistrate, there is no bar.

Having regard to the above, with these observations, the Criminal Petition is dismissed, as the petitioner/A-6 does not deserve the concession of anticipatory bail including from his age from the propensity of the crime and its perpetration.
Dr. SSRB,J Crl.P.No.832 of 2019 Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
