THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN Civil Revision Petition No.3671 of 2015 ORDER:
The order, under challenge in this C.R.P, is the order passed by the Judge, Family Court-cum-V Additional District and Sessions Judge, Visakhapatnam in I.A.No.324 of 2014 in O.P.No.1294 of 2013 dated 01.06.2015, whereby a sum of Rs.12,000/- per month was directed to be paid by the petitioner as interim maintenance to the respondent. In the order under revision, the Court below noted that, while the respondent had contended that the petitioner's salary was Rs.1,00.000/- per month, the respondent had stated that he was only receiving Rs.30,000/- per month towards honorary service being rendered to the Government . The Court below held that the petitioner had an obligation to maintain his wife and, consequently, directed him to pay interim maintenance, of Rs.12,000/- per month to the respondent from the date of the petition.
While Smt. K.S.G.Padmavathi, learned counsel for the petitioner, would submit that the petitioner has loans which he is required to discharge, the petitioner has also an obligation to maintain his wife. The interim maintenance awarded by the Court below of Rs.12,000/- per month is itself meagre in a large City like Visakhapatnam. I see no error in the order of the Court below necessitating inference in proceedings under Article 227 of the constitution of India.
The Civil Revision Petition fails and is, accordingly, dismissed. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs. ______________________________ RAMESH RANGANATHAN, J 11th September 2015.
