THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.864 OF 2018 ORDER:
This petition is filed by the petitioners (respondents 1 to 6) under Section 482 Cr.P.C. to quash the proceedings in DVC No.31 of 2017 on the file of the Special Judl. Magistrate of I Class for trial of Prohibition and Excise Offences, Nellore.

Heard learned counsel for the petitioners, learned Assistant Public Prosecutor representing the State and perused the record.

Having argued for some time, learned counsel for the petitioners would submit that the personal attendance of the petitioners, who are respondents in the above DVC may be dispensed with.

Learned Assistant Public Prosecutor conceded the same.

DVC case is not a criminal case proceedings.
Personal attendance of the petitioners, who are respondents 1 to 6 in DVC on the dates of hearings are not required under law. In similar circumstances, there are also decisions of this Court dispensing with the personal attendance of the petitioners-respondents.
In view of the facts and circumstances of the case, the learned Magistrate shall not insist the personal appearance of the petitionersrespondents 1 to 6 in DVC unless there is specific purpose of their appearance.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
