THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.2968 of 2019 ORDER:

The grievance of the petitioners is that the Sub-Registrar, Adilabad District, respondent No.4 herein, is not entertaining the document presented by them for registration in relation to land admeasuring Acs.3.75 cents in Survey No.181/39/2 (old Survey No.181/22) of Mavala Vilalge, Mavala Mandal, Adilabad District. Sri Gudi Madhusudhan Reddy, learned counsel for the petitioners, would inform this Court that a similar case in W.P.No.40037 of 2018 was disposed by the erstwhile common High Court for the States of Telangana and Andhra Pradesh vide order dated 08.11.2018. A copy of the said order is placed on record. Perusal thereof reflects that the learned Judge disposed of the Writ Petition taking note of the provisions of Section 71 of the Registration Act, 1908 (for short, 'the Act of 1908').

For reasons alike as were mentioned in the aforestated order and in terms thereof, the Writ Petition is disposed of directing the Sub-Registrar, Adilabad District, to receive and process the document presented by the petitioners. In the event the said document is found to be in order and in full compliance with the requirements of the Act of 1908, and the Indian Stamp Act, 1899, the Sub-Registrar, Adilabad District, shall complete the registration formalities and release the document after due registration.

pass a reasoned order of refusal under Section 76 of the Act of 1908 and communicate the same to the petitioner. The exercise, one way or the other, shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
