THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.903 OF 2012 ORDER:
This Criminal Revision Case is filed under Section 397 read with 401 of Cr.P.C. challenging the judgment dated 17.01.2012 in Crl.A.No.58 of 2011 on the file of the Court of XIII Additional Sessions Judge, Krishna at Vijayawada, wherein and whereby confirming the judgment dated 25.03.2011 in C.C.No.1267 of 2007 on the file of the Court of I Additional Chief Metropolitan Magistrate, Vijayawada. A perusal of the record reveals that the second respondent faced the trial in C.C.No.1267 of 2007 on the file of the Court of I Additional Chief Metropolitan Magistrate, Vijayawada for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881.
After full-fledged trial, the trial Court arrived at a conclusion that the second respondent was not found guilty for the offence punishable under Section 138 of the Negotiable Instruments Act and was acquitted. Feeling aggrieved by the judgment of the trial Court, the petitioner filed Crl.A.No.58 of 2011. The appellate Court dismissed the said appeal on 17.01.2012 confirming the judgment of the trial Court. Learned counsel for the petitioner submitted that the sole proprietor of the petitioner firm died long back. In spite of several adjournments, the learned counsel for the petitioner did not take any steps to bring the legal representatives of the proprietor of the petitioner firm. Hence, no purpose will be served by keeping the matter pending.
Accordingly, the Criminal Revision Case is dismissed as abated.
Consequently, Miscellaneous Petitions, if any, pending in this Criminal Revision Case shall stand closed.
