HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27920 OF 2017 ORDER:

It is the case of the petitioner that she was working as Conductor in the respondent Corporation; that she made request to the authorities for alternate employment as she was suffering with fits due to blood clot in brain; and that the authorities vide proceedings dated 21.05.2016 considered her request and accordingly the petitioner was permitted to perform out of designation duties in the DC earning section for four months and again the same was extended for a further period of six months till July, 2017. Thereafter, when she requested for extension of OD duties, the same was not extended and petitioner was not paid salaries since May, 2015. As such, petitioner submitted representation dated 29.05.2017 before the 3rd respondent requesting to continue her in alternate employment and to pay salaries. As the same is not being disposed of present writ petition is filed. Respondent Corporation filed counter stating that when once the period for which the petitioner was posted expired, petitioner has to join duty and that again the petitioner cannot seek extension of that period.

Heard learned counsel for the petitioner and Sri P.Durga Prasad, learned Standing Counsel for respondent Corporation.

It is to be seen that if petitioner feels that she is not fit physically, she has to make proper application before the competent authority and the competent authority shall consider the same and take action.

In view of the above it is open for the petitioner to make necessary application before the competent authority and on such application being made by the petitioner the competent authority shall consider the same and take appropriate action by referring the petitioner to Medical Board as per Regulations of the respondent Corporation, within a period of two weeks from the date of receipt of such application from the petitioner.

Accordingly the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 19.09.2017 tk
