HON'BLE SRI JUSTICE RAMESH RANGANATHAN CONTEMPT CASE No.657 of 2013 ORDER:
In its order in W.P.No.40181 of 2012 dated 26.02.2013, this Court recorded the undertaking of the Investigating Officer, that he would complete investigation within three weeks from that date, and file a final report in the Court under Section 173(2) Cr.P.C. by then. The three week period expired on 17.03.2013. A final report, under Section 173(2) Cr.P.C, was admittedly filed only on 28.03.2013. The delay in complying with the order of this Court is 11 days. While, in the first counter affidavit dated 17.06.2013, it is stated that a final report was filed on 19.03.2013, in the subsequent counter affidavit dated 02.12.2014 it is rightly stated that a final report was filed on 28.03.2013.
While the casual manner in which affidavits are filed in Court must be deprecated, the delay of 11 days in filing the charge sheet is not so inordinate as to warrant action being taken against the officer under the Contempt of Courts Act. I see no reason, therefore, to proceed further under the Contempt of Courts Act. The Contempt Case is, accordingly, closed. Miscellaneous petitions pending, if any, shall stand closed.
