THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12067 of 2015

ORDER

This criminal petition under sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioners-A1 and A2 seeking to grant bail in connection with Cr.No.49 of 2015 of Cheedikada Police Station, Visakhapatnam District, registered for the offence punishable under Section 20(b)(1) read with Section 8(c) of NDPS Act.

2. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

3. It is alleged that on 07.08.2015, on information, the police officials rushed to near Fire Crackers godown at Bailapudi village and found the accused in possession of five gunny bags containing 100 Kgs of ganja for the purpose of illegal transportation.

4. Since the contraband seized from the possession of the accused is a commercial quantity, this Court is not inclined to grant bail to them.
