THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 2470 of 2018 O R D E R :

Notices dated 01.11.2017 issued by the 2nd respondent Executive Officer demanding the petitioner to pay the property tax at Rs.2,01,000/- per annum for the period from 2015-16 to 201718, are challenged before this Court. The specific contention of the petitioner is that as per the procedure and methodology notified in G.O.Ms.No.282, dated 12.03.1965, the petitioner's tax liability per annum would come to Rs.45,000/- approximately.

On the other hand, learned Standing Counsel for the Gram Panchayat submits that as against the demand, an appeal is provided for in terms of G.O.Ms.No. 30, dated 20.01.1995. Having considered the respective submissions, since it is the specific contention of the petitioner that the methodology notified in G.O.Ms.No. 282, dated 12.03.1965 has not been followed by the gram panchayat, in the facts of the present case, the respondent gram panchayat shall furnish the petitioner as to how and in what manner a sum of Rs.2,01,000/- per annum has been arrived at as the tax payable by it. The said calculation shall be provided to the petitioner within two weeks from today. Meanwhile, the petitioner shall pay a sum of Rs.2 lacs, on ad hoc basis, which shall be given credit to during the final assessment that may be made by the 2nd respondent.

The Writ Petition is accordingly, disposed of. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
