THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.36493 of 2015 ORDER:
The grievance of the petitioner was that the Station House Officer, Nellore Rural Police Station, Nellore, SPSR Nellore District, the third respondent, was harassing him by requiring him to attend the police station everyday and threatening to evict him from the property which is the subject matter of O.S.No.240 of 2015 on the file of the learned III Additional Junior Civil Judge, Nellore.
The Station House Officer, Nellore Rural Police Station, furnished written instructions dated 16.11.2015 to the office of the learned Government Pleader for Home, wherein he denied the allegations made by the petitioner that he was harassing the petitioner and threatening to evict him from his property. The Station House Officer further stated that the petitioner was arrayed as accused No.1 in Crime No.306 of 2015 registered on the file of Nellore Rural Police Station under Sections 323, 379, 427 and 447 I.P.C. read with Section 34 I.P.C. He further stated that the petitioner had already obtained conditional bail in relation to the said crime and therefore the question of his being called to the police station did not arise. The allegations made to the contrary by the petitioner were denied.
The stand of the police authorities, as set out in the afore-stated written instructions, is duly taken on record. In the light thereof, no adjudication is warranted in this writ petition, which is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
