HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2935 of 2020 ORDER:
It is stated by the learned counsel for the petitioner that the lis in this writ petition is squarely covered by the order of this Court in WP No.26118 of 2019 dated 27.11.2019 and same is not disputed by the learned Assistant Government Pleader for revenue appearing for respondents.
In view of the same and for the reasons alike in the order dated 27.11.2019, this writ petition is also disposed of directing the registering authority to receive and process the deeds of conveyance without reference to the District Gazette notification dated 26.09.2013 subject to compliance of the provisions of the Indian Registration Act,1908 and Indian Stamp Act, 1899. It is also open to the registering authority to refuse to register the deeds presented before him, if he has any other objection, by duly assigning reasons in support of such decision and communicate the said decision to the petitioner. It is made clear that mere registration of deeds of conveyance does not confer title to the property. It is also made clear that this order does not preclude the Government/District Collector to take appropriate steps as warranted by law and to assert its title.
There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
