THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 2461 of 2018 O R D E R :

Questioning the inaction on the part of the 3rd respondent Special Deputy Collector (Land Acquisition) in deciding the claim of the petitioners for payment of compensation for the land acquired in an extent of Acs. 38.42 cents covered by various survey numbers situated at Kopalli Village, V.R. Puram Mandal of East Godavari District pursuant to the Award Inquiry Notice dated 02.05.2017.

Heard learned counsel for the petitioner as well as learned Government Pleader for Land Acquisition (Andhra Pradesh). It appears, the petitioners filed the Writ Petition with an apprehension that the respondents may not take into consideration the objections raised by them on 10.11.2017 before the 3rd respondent, pursuant to the notice issued on 02.05.2017 under Section 21 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

Inasmuch as the notification was issued on 02.05.2017 calling for objections to be filed on or before 25.05.2017, if no Award is made as on date, the respondent authorities are directed, before passing the Award, to consider the objections filed by the petitioners on 10.11.2017 making a claim with respect to the compensation amount. It is made clear that the petitioners may be given an opportunity of hearing to substantiate their claim, before making an Award.

Subject to the above, the Writ Petition is disposed of. No costs.

Consequently, the miscellaneous Applications, if any shall also stand closed.
