HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.1613 OF 2016 ORDER:
The present Civil Revision Petition under Article 227 of the Constitution of India is filed by the petitioner - defendant challenging the order dated 03.02.2016 in I.A. No.538 of 2015 in O.S. No.1394 of 2014 passed by the learned I Additional Senior Civil Judge, Vijayawada, whereby the petition filed under Section 45 of the Indian Evidence Act, 1872 read with Section 151 of the Code of Civil Procedure, 1908, seeking to send the suit promissory note to the handwriting expert for the purpose of comparison of his (petitioner) signature on the suit promissory note with his (petitioner) admitted signatures on vakalat, written statement and the affidavit and for his report, was dismissed.
2. As per the material placed before this Court, the original suit bearing No.1394 of 2014 itself was disposed of decreeing the suit with costs by the trial Court on 29.03.2016 requiring no further adjudication in this revision.
3. Therefore, the Civil Revision Petition is dismissed as infructuous. No order as to costs.
