THE HONOURABLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.878 of 2019 ORDER :

The petitioner is the complainant. The 2nd respondent is the accused. The prayer in the criminal petition is to direct the learned Special Magistrate to give early disposal of the case covered by the offence under Section 138 of the Negotiable Instruments Act (for short, 'the N.I.Act'), in saying the original case before the XX Metropolitan Magistrate, Malkajgiri, was with C.C.No.40 of 2017 and it is by virtue of the transfer, fresh number allotted in 2019 (C.C.No.27 of 2019) and as per mandate of Sections 138 to 145 of the N.I. Act and it is a summary trial, required for early disposal and thereby he is seeking the prayer.

Having regard to the above, without requirement of any notice to the 2nd respondent/accused, the criminal petition is disposed of directing the learned Special Magistrate to dispose of the said case preferably within three months from the date of receipt of a copy of the order by giving priority.
