Sc, St, B.C And Minorities Harijana Seva Sangam, Rep.By Its v. The State Of Telangana, Rep.By Its Principal Secretary,
HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.7472 OF 2017 O R D E R:
SC, ST, BC and Minorities Harijana Seva Sangham, Kummarikunta, Uppal Mandal, Medchal District, is the petitioner. It seeks to assail the inaction of the revenue authorities upon its representation dated 16.11.2016. By way of the said representation, the petitioner-organisation asked for allotment and distribution of house sites in Sy.No.789/1 of Uppal Village, Uppal Mandal, Medchal District.
Perusal of the writ affidavit and the representation dated 16.11.2016 demonstrates that the petitioner-organisation did not furnish any details whatsoever as to its members. Sri K.Durga Prasad, learned counsel representing Ms. Baske Padmavathi, learned counsel for the petitionerorganisation, would however state that land is available as on date and the claims of the members of the petitioner-organisation could be considered by the State of Telangana as per the extant policy. As this Court finds that sufficient information was not been given in the representation dated 16.11.
2016 as to the number and the details of the members of the petitioner-organisation; their eligibility to seek allotment of house sites; and the nature of the scheme under which they seek such allotment, this Court is of the opinion that the revenue authorities cannot be found fault with for their alleged inaction over the vague representation dated 16.11.2016, which is bereft of necessary details. The Writ Petition is accordingly disposed of permitting the petitioner - organisation to make a proper representation setting out full particulars as to number and the details of its of members and their eligibility, apart from the Government policy under which they seek allotment, and the details of the vacant land, if available, for such allotment.
organisation makes such a representation, the same shall be considered by the District Collector, Medchal-Malkajgiri District, on its own merits and in accordance with law expeditiously.
Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
