HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No. 2924 OF 2017 ORDER:
This writ petition is filed for the following relief: "... to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the proceedings of the 2nd respondent bearing Rc.No.1297/2015-G4, dated 02.04.2015, as illegal, arbitrary, unconstitutional and contra to the principles of natural justice." Heard the learned counsel for the petitioners and the learned Government Pleader for Panchayat Raj for the respondents. It is submitted by the learned counsel for the petitioners that the issue involved in the present writ petition is squarely covered by the order of this Court in Somagani Venkata Subbamma v. District Panchayat Officer, Krishna District and another1. Paragraph 9 of the said order reads as under:
"In this case, the petitioner herein was prohibited from drawing the Gram Panchayat funds permanently and completely, which is not contemplated under Rule 42(1) of the Rules. For this reason, the writ petition has to be allowed."
Following the above order and for the reasons recorded therein, this writ petition is allowed in terms thereof. However, it is open for the respondents to take action in accordance with law. Miscellaneous petitions, if any pending, shall stand closed. No order as to costs.
