THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37935 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus to declare the action of respondent No.1 in not including appropriate offences under sections 419, 307 and 182 r/w 34 IPC and section 5 (b) of the A.P. Land Grabbing (Prohibition) Act, 1982 in FIR No. 339/2016 in spite of the contents of the complaint clearly disclose the commission of the said offences as arbitrary, illegal and consequently direct respondent No.1 to include the offences under sections 419, 307 and 182 r/w 34 IPC and section 5 (b) of the A.P. Land Grabbing (Prohibition) Act, 1982 in FIR No. 339/2016 and proceed with the investigation in accordance with law by arresting the accused and file the charge sheet before the Court in the interest of justice."

Heard and perused the material available on record. 3.

The petitioner approached this Court for alteration of F.I.R.No.339 of 2016 on the file of Golkonda Police Station, Hyderabad by including the aforementioned offences. Hence, this Court is of the view that the writ petition is liable to be dismissed as not maintainable.

Accordingly, the Writ Petition is dismissed as not maintainable. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
