THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY PETITION No.292 OF 2015 ORDER:

The Company Petition is filed seeking to order winding up of the respondent's company on the ground of its inability to pay the debts to the petitioner company.

After notice, the respondent entered appearance. Today, when the matter is taken up for hearing, the learned counsel for the petitioner filed a Company Application No.639 of 2017 along with a joint memorandum of compromise seeking permission of this Court to withdraw the Company Petition in furtherance of the compromise entered into between the parties on 07.07.2017. In view of the settlement reached between the parties, the Company Petition is liable to be closed and the Compromise memo dated 07.07.2017, is taken on record.

Accordingly, the Company Petition is closed. However, in the light of the compromise arrived at between the parties and the main Company Petition is closed, the office to return all the original documents filed along with the Company Petition to the petitioner. No order as to costs. Miscellaneous Petitions, if any pending in this C.P, shall also stand closed.
