THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.2520 of 2018 ORDER:
The grievance of the petitioner in this case is in relation to the Memo dated 14.03.2016 whereby the Tahsildar, Palvancha Mandal, rejected his application in Form VI(A) for effecting mutation in his favour in respect of the subject land.
Be it noted that a hierarchy of remedies is provided under the Telangana Rights in Land and Pattadar Pass Books Act, 1971, if the petitioner is aggrieved by the aforestated memo. Without taking recourse to the statutory remedies provided to him, it is not open to the petitioner to come before this Court by way a writ petition under Article 226 of the Constitution. The Writ Petition is accordingly dismissed leaving it open to the petitioner to take recourse to the appropriate statutory remedy available to him in accordance with law. The time consumed in pursuing this writ petition shall stand excluded by the authority concerned. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
