HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:
Petitioners allege that respondent Police are interfering with the civil rights of possession and title of petitioner firm over the house property bearing No.10-3-32/9/3/A, Addagutta Slum, East Marredpally, Secunderabad. According to the petitioners, they have obtained building permission on 23.07.2018 and are undertaking construction in accordance with the building permission granted. Therefore, Police cannot interfere in construction activity of the petitioners and cannot involve in civil disputes. 2.
According to the learned Government Pleader, 5th respondent herein lodged complaint on 11.02.2019. Based on the said complaint, GD entry was made, but so far no further steps are taken. Learned Government Pleader, on instructions, therefore denies that respondent Police are interfering in civil rights of possession and title of the property, as alleged by the petitioners. 3.
Apparently, so far no crime is registered and, therefore, without registering the crime, Police cannot harass private person and affect his right to possession and enjoyment at any rate. Thus, leaving it open to petitioners to take further steps in accordance with law if aggrieved by the complaint already lodged, Writ Petition is dismissed. Pending miscellaneous petitions shall stand closed.
