THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.36539 OF 2014 ORDER:
This writ petition is filed challenging the action of the respondents in not conducting election to the 5th respondent's society and continuing the persons in charge from time to time.
2. It is stated that the society's area of operation is confined to G.Medapadu village and its hamlets and there are nearly 128 members. The said society was under the management of part time person in charge since 2006. The Commissioner of Fisheries had directed the 3rd respondent to conduct elections to the society vide his memo, dated 02-12-2009. Thereafter, the elections were conducted on 06-07-2010 and all the nine Managing Committee members were elected unanimously. The petitioner was elected as Vice President and he assumed charge on 06-07-2010. Since the President expired on 25-04-2012, the petitioner was elected as a President till the Managing Committee was superceded by proceedings, dated 25-04-2014. Thereafter, the society is being run by three members persons in charge. In the circumstances, the present writ petition is filed.
3. In view of the supersession of the committee on 25-04-2014 and continuance of persons in charge since that time, respondents 2 to 4 are directed to initiate election process and complete the same within a period of three months from the date of receipt of a copy of this order.
4. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed. _______________________________ A.RAMALINGESWARA RAO, J DATED: 06-10-2015
