Mr.K.John Kiran Kumar v. Mr.E.Murali,
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.787 OF 2015 O R D E R :
The Contempt Case is filed alleging violation of order dated 10.09.2014, passed by this Court in WP.No.26574 of 2014. The order passed by this Court on 10.09.2014 is as follows;
".........the respondents 4 and 5 are directed to supply stocks to the petitioner's fair price shop as long as petitioner's authorisation is valid and subsisting."
The grievance of the petitioner is that he was supplied stocks till March, 2015.
Thereafter, the respondents stopped supplies to the petitioner's fair price shop.
When the matter came up for hearing, learned Assistant Government Pleader for Civil Supplies produced order dated 23.03.2015, showing that petitioner's fair price shop authorisation is suspended for the irregularities committed by him. He further states that in view of the suspension order, supply of essential commodities to the petitioner's fair price shop was stopped.
In view of the above, I do not see any contempt of the order dated 10.09.2014, passed by this Court, by the respondents.
Accordingly, the Contempt Case is dismissed.
However, liberty is given to the petitioner to challenge the suspension order dated 23.03.2015 in the appropriate proceedings. No order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the contempt case, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 25.06.2015 t k.
