This writ petition is filed challenging the action of the 2nd respondent in entertaining the appeal under Section 5(5) of the A.P.Records of Rights in Land and Pattedar Passbooks Act, 1971, against a Memo No.B/33/4/2019, dated 27.12.2019. Learned Counsel for the petitioners submits that the unofficial respondents approached the 3rd respondent-Tahasildar against the entries made in favour of the petitioners and the Tahasildar rejected the said application on 27.12.2019 vide Memo No.B/33/4/2019. Aggrieved by the said memo, the unofficial respondents preferred appeal before the 2nd respondent. He also submits that the entries made in favour of the petitioners are not challenged in the appeal, as such the appeal is not maintainable.

Heard learned Assistant Government Pleader for Revenue. It is to be seen that as on today, no adverse order is passed against the petitioner and the appeal is filed by the unofficial respondents challenging the Memo dated 27.12.2019 issued by the 3rd respondents. Further, in the grounds of appeal, it is mentioned that illegal entries are made in favour of the petitioners. According to petitioners there are no merits in the appeal. All these aspects have to be considered by the 2nd respondent in the appeal.

In view of the same, I do not see any reason to entertain the writ petition.

Accordingly, the writ petition is dismissed. However, it is open for the petitioners to raise all their pleas before the 2nd respondent and the 2nd respondent is obligated to consider the same and dispose of the appeal. No order as to costs.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. __________________________ A.RAJASHEKER REDDY, J 13.02.2020 tk
