THE HON'BLE SRI JUSTI CE V. RAMASUBRAMANI AN C.R.P.No.4654 of 2016 ORDER:

Aggrieved by the action of the Court below in not numbering an application for appointment of an Advocate Commissioner, the petitioner has come up with this revision.

2. Irrespective of the fact whether the prayer made in an interlocutory application can be granted or not, the Court below is obliged at least to number the application, take it up for hearing and decide it on merits, provided the application is filed in the proper format and with requisite court fee. Therefore, the civil revision petition is disposed of directing the trial Court to number the interlocutory application for appointment of a Commissioner and decide it after affording an opportunity to the respondents, in accordance with law on its own merits.

3. As sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
