THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25550 of 2015 ORDER:
The petitioner was appointed as a fair price shop dealer of shop No.48, Nandigama Village, Sattenapalli Mandal in Guntur District and the authorisation of the petitioner is subsisting as on today. When the petitioner was not available on 06.08.2015, the shop was inspected and no proceedings were issued thereon. However, the supply of the stock was stopped without issuing any proceedings. Challenging the nonsupply of the stock, the present Writ Petition is filed. Though the Writ Petition was adjourned three times, no instructions were issued to the learned Government Pleader. In the circumstances, the petitioner is entitled to get the stock so long as the authorisation of the petitioner is in force.
The Writ Petition is, accordingly, disposed of directing respondent Nos.2 and 3 to supply the stock to the petitioner so long as her authorisation is in force and valid as on today. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
